Terms of Service

These Terms govern your use of the Baldur website (https://baldur.sh), the Baldur open-source software, and the Baldur PRO commercial license (together, the "Services"), provided by MH WORKS ("we", "us"). By using the Services or purchasing a license, you agree to these Terms.

1. The software

  • OSS core. The open-source Baldur package is licensed under the Apache License 2.0. Your use of the OSS core is governed solely by that license.
  • PRO. Baldur PRO is commercial software made available under a paid license. These Terms, together with the license terms delivered with your purchase, govern your use of PRO.

The Services are intended for developers, businesses, and other professional users, and are not directed to consumers for personal or household purposes.

2. Purchases and the Merchant of Record

Purchases of Baldur PRO are processed by Creem, which acts as the Merchant of Record. This means:

  • Your purchase is a transaction with Creem. Creem handles payment, invoicing, and applicable taxes.
  • Creem's own terms and refund handling apply to the payment transaction.
  • We issue your PRO license upon confirmation of a completed purchase.

3. License grant (PRO)

Subject to payment and ongoing compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use Baldur PRO for the plan and term you purchased. You may not:

  • redistribute, resell, sublicense, or publish the PRO source or license keys;
  • remove or circumvent license validation;
  • use the Services to build a competing product.

4. Cancellations and refunds

You may cancel a PRO subscription at any time. Cancellation stops future billing; your access continues until the end of the current billing period. The unused portion of a billing period is not refunded.

14-day money-back. If Baldur PRO is not a fit, email support@baldur.sh within 14 days of your purchase and we will refund that payment — no questions asked.

Payments are processed by Creem as Merchant of Record; we coordinate any refund with Creem, and Creem's checkout terms also apply to the payment transaction.

5. No warranty

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

What Baldur is and is not. Baldur is a resilience library that helps your application handle failures (circuit breaking, retry, fallback, dead-letter queue). It reduces the impact of certain failures; it does not guarantee that your application will never fail, never lose data, or achieve any particular level of availability. You remain responsible for testing, configuring, and operating your own systems.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRO LICENSE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in this section limits liability for willful misconduct or gross negligence by MH WORKS, or any liability that cannot be excluded or limited under applicable law.

7. Indemnification

You agree to defend, indemnify, and hold harmless MH WORKS from and against any third-party claims, losses, damages, and expenses (including reasonable legal fees) arising out of your use of the Services or your violation of these Terms.

8. Acceptable use

You agree not to use the Services unlawfully, to infringe the rights of others, or to attempt to disrupt or gain unauthorized access to the Services or their infrastructure.

9. Termination

We may suspend or terminate a PRO license for material breach of these Terms, including license abuse. The disclaimers and liability limits survive termination.

10. Changes

We may update these Terms. We will post material changes on this site at least 7 days before they take effect — at least 30 days in advance for changes unfavorable to you — stating the effective date and the reason for the change. If you do not reject a change before its effective date, you are deemed to have accepted it; you may decline by discontinuing use of the Services and contacting support@baldur.sh.

11. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules. Disputes are subject to the jurisdiction of the courts of the Republic of Korea.
